Terms of Service — Bronzata Beauty

Bronzata Beauty is a brand of Enlightenment Club LLC, Wyoming Limited Liability Company (USA). These Terms of Service ("Terms") govern access to and use of the website bronzata.com and the purchase of Bronzata Beauty products by users.

Before making a purchase, we invite you to read these Terms carefully. Use of the website and/or placement of an order constitutes full and unconditional acceptance of these Terms, the Privacy Policy, the Refund Policy, the Subscription Policy and the Cookie Policy.


1. Definitions

"Bronzata", "we", "our": Enlightenment Club LLC, Wyoming Limited Liability Company, operating under the trade name "Bronzata Beauty". "Customer", "you", "your": any natural or legal person who accesses the website or makes a purchase. "Website": bronzata.com and all its sub-pages. "Products": cosmetic articles and accessories sold by Bronzata. "Order": contractual proposal for purchase submitted by the Customer via the Website. "Subscription": recurring supply contract governed by the Subscription Policy.


2. Subject Matter and Scope

These Terms govern: (a) access to and use of the Website; (b) the conclusion of the sales contract between Bronzata and Customer; (c) economic conditions, delivery, warranty and withdrawal rights; (d) mutual rights and obligations. These Terms apply to all orders placed via the Website, except for express written derogations specifically agreed.


3. Acceptance of Terms

3.1 Use of the Website constitutes full acceptance of these Terms. If you do not accept these conditions, we invite you not to use the Website or place orders.

3.2 During checkout, the Customer is invited to specifically accept, via dedicated checkboxes, the onerous clauses concerning: limitation of liability (§15), jurisdiction (§22), Subscriber subscriptions (§23), anti-abuse measures and Welcome eligibility (Subscription Policy §5-6), refunds and chargebacks (Subscription Policy §9-11).


4. Capacity to Contract

To place orders on the Website, you must be 18 years of age or older and have full contractual capacity under the laws applicable in your jurisdiction. Bronzata reserves the right to request proof of identity to verify the Customer's age in case of reasonable suspicion. Orders placed by minors will be cancelled with full refund.


5. Account and Registration

5.1 Creating an account is not required to place an order, but it is recommended to access your account area (subscription management, shipment modifications, order history).

5.2 The Customer is responsible for safeguarding their credentials and for all activity conducted via their account. In the event of suspected unauthorised access, the Customer must immediately notify support@bronzata.com.

5.3 Bronzata reserves the right to suspend or delete accounts in the event of breach of these Terms, documented fraud, abusive behaviour, unfounded chargeback or prolonged inactivity exceeding 36 months.


6. Products and Descriptions

6.1 Bronzata sells functional cosmetic products (body coverage, body makeup, accessories). Descriptions, images and technical specifications published on the Website are provided for informational and illustrative purposes only.

6.2 Minor variations in colour, packaging, shade, fragrance between the product depicted and the one delivered do not constitute a product defect nor justify refund requests.

6.3 Bronzata reserves the right to modify at any time the formulation, design, packaging and specifications of products, without notice, for reasons of quality improvement, regulatory compliance or raw material availability.

6.4 Bronzata products are cosmetics for external use. They are not medical products, pharmaceuticals, medical devices or therapeutic products. They do not substitute medical prescriptions or dermatological treatments. In the case of skin conditions, pregnancy, breast-feeding or ongoing pharmaceutical therapies, consult your physician before use.


7. Prices and Price List

7.1 Prices published on the Website are expressed in Euros (€), including VAT according to the current Italian rate. Shipping costs, if applicable, are calculated and shown at checkout before order confirmation.

7.2 Current price lists: Coverage Cream — One-Time €34.99 · Subscriber 1st order €29.99 · Renewals €29.99 every 30 days. Even Skin Kit — One-Time €59.98 · Subscriber 1st order €49.98 · Renewals €49.98 every 30 days (Kabuki Brush always included free).

7.3 Strikethrough list prices displayed on the Website ("€49.99", "€99.98") represent the perceived value or average market price for comparable products, and do not constitute the price actually charged to the Customer. The price actually charged is always the one active at the time of order, clearly shown before purchase confirmation.

7.4 Bronzata reserves the right to modify prices at any time. Any modifications do not apply retroactively to orders already confirmed. For active subscriptions, any price variations will be notified to the Customer at least 30 days in advance via email, with the option to cancel without penalty.

7.5 Price errors. In the event of a manifest price error (e.g. price disproportionately below market value, clearly incorrect due to typographical error), Bronzata reserves the right to cancel the order before shipment with full refund.


8. Orders and Contract Conclusion

8.1 The order placed by the Customer constitutes a contractual proposal for purchase. The contract is concluded at the moment of written confirmation of the order by Bronzata, sent via email to the address provided by the Customer.

8.2 Bronzata reserves the right to refuse orders for the following reasons: (a) product stock exhausted; (b) manifest price errors; (c) suspected fraudulent or abusive behaviour; (d) inability to deliver to the provided address; (e) Customer on ban list for prior breach of Terms or fraudulent chargeback; (f) suspicious multiple orders from the same identity (see Subscription Policy §5-6).

8.3 In the event of order refusal, Bronzata will notify the Customer via email within 48 business hours, with full refund of any amounts charged.

8.4 The Customer is responsible for the accuracy of the information provided at the time of order (name, address, telephone, email). Bronzata is not responsible for failed or incorrect delivery due to inaccuracies in the information provided.


9. Payment

9.1 Accepted methods: credit/debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, PayPal, Shop Pay, Klarna (if available). Payment data is processed via PCI-DSS certified gateways (Shopify Payments, Stripe). Bronzata does not have direct access to the Customer's complete card data.

9.2 Payment on order. The amount is charged at the time of order confirmation. For subscriptions, subsequent renewals are automatically charged on the scheduled renewal date, as per the Subscription Policy.

9.3 Payment refused. If payment is declined by the processor (insufficient funds, card expired, fraud block), the order is not confirmed. For subscriptions, Bronzata will retry the charge 3 times over 7 days; if unsuccessful, the subscription will be suspended until payment method is updated.

9.4 Invoicing. To request an invoice, the Customer must provide tax information (tax ID, VAT number, SDI recipient code) before order confirmation. Invoices requested post-shipment are not guaranteed.


10. Shipping and Delivery

10.1 Timescales. Preparation 1-3 business days (express 24 hours available at checkout). Delivery 4-10 business days. The timescales indicated are estimates, not essential delivery dates.

10.2 Free shipping. On all orders, in every country served, with no minimum order value.

10.3 Risk transfer. Risk of loss or damage to the product transfers to the Customer at the moment of documented delivery (tracking "delivered", signature or courier photo). In case of evident damage upon delivery, the Customer must report it to the courier and to support@bronzata.com within 48 hours.

10.4 Non-collection. In the event of non-collection of the package with return to sender for reasons attributable to the Customer (wrong address, repeated absence, refusal), the conditions of the Refund Policy §5 apply (handling charge €7.50 + no automatic refund).

10.5 International shipments. For shipments outside the EU, any customs duties, import VAT and local taxes are the responsibility of the receiving Customer.


11. Right of Withdrawal (Consumer Code Art. 52)

A Consumer Customer resident in the EU has the right to withdraw within 14 days from receipt of the product, without need for reason, under the Consumer Code Art. 52 as amended.

Legal exclusion for opened cosmetics (Consumer Code Art. 59.1.e). Bronzata cosmetic products fall within the legal exclusion: withdrawal is permitted only for sealed and unopened products. For full discipline, conditions, RMA procedure, refundable amount and timescales, reference is made to the Refund Policy.


12. Legal Warranty of Conformity

12.1 Bronzata products are covered by the legal warranty of conformity of 24 months under the Consumer Code Arts. 128-135 (Consumer Sales Directive 1999/44/CE and EU Directive 2019/771), within the limits of shelf life and PAO (Period After Opening) specific to cosmetic products.

12.2 In case of non-conformity, the Customer has the right to remedy the non-conformity (free replacement) or, alternatively, to an appropriate price reduction or contract termination. The claim must be sent within 2 months of discovery of the defect to support@bronzata.com with photographic documentation.

12.3 The warranty does not cover: damage caused by improper use of the product in violation of usage instructions; damage after opening the package and use (normal deterioration); individual skin reactions not attributable to documented manufacturing defect (individual sensitivity is not a defect); products expired due to causes attributable to the Customer (incorrect storage).


13. Prohibited Uses

It is strictly prohibited to use the Website and Services for: (a) any unlawful or harmful purpose, in breach of national, European or international laws; (b) soliciting others to commit unlawful acts; (c) violating regulations, standards, local or international laws; (d) transmitting viruses, malware or harmful code; (e) collecting or monitoring personal data of others without authorisation; (f) sending spam, phishing, pretexting, spiders, crawls, scrapes; (g) using robots, bots, scrapers, scraping tools, AI agents (including agentic LLMs) to extract content from the Website; (h) attempting to access non-public areas of the Website, servers, infrastructure; (i) interfering with, circumventing or eluding security features, authentication, Website integrity.

13bis. Subscriber anti-abuse. Further prohibited use includes: activation of Subscriber subscriptions with the sole purpose of exploiting the Welcome discount reserved for new customers, without intent of continued use (sub-and-cancel abuse); reuse of the Welcome Discount through creation of multiple accounts, minor address variations, use of different payment cards in the same person's name, email aliases, or other techniques to circumvent the automatic controls of Subscription Policy §5-6. Bronzata reserves the right to cancel orders, exclude accounts from future promotions, charge price differentials or take legal action in case of documented breach.

13ter. Fraudulent chargebacks. Prohibited use and serious breach of contract includes the opening of chargebacks with the payment network without prior communication to support@bronzata.com, and in particular the opening of chargebacks on orders delivered regularly and not returned. Such conduct may constitute fraud and will be pursued in all competent forums.


14. Intellectual Property

14.1 All content on the Website (marks, logos, names, texts, images, photographs, videos, graphics, layout, source code, design) are the exclusive property of Enlightenment Club LLC or third parties who have licensed it, and are protected by Italian, European and international laws on intellectual property and copyright.

14.2 Any reproduction, distribution, modification, reverse engineering, decompilation, republication, systematic downloading, scraping, commercial use of content without explicit written authorisation from Bronzata is prohibited.

14.3 A Customer who publishes reviews, photos, videos, user-generated content relating to Bronzata on social media or on the Website grants Bronzata a non-exclusive, free, perpetual, worldwide, transferable licence to use, reproduce, modify, distribute such content for commercial and marketing purposes.


15. Limitation of Liability

15.1 Bronzata provides the products "as is" and "as available", to the extent permitted by applicable law. Descriptions and information published on the Website are provided for informational purposes.

15.2 To the extent permitted by law, Bronzata is not responsible for: (a) indirect, consequential damages, loss of profits, opportunity, data or reputation arising from use of the products or Website; (b) individual skin reactions not attributable to documented manufacturing defect (individual sensitivity is not a defect); (c) aesthetic results subjectively different from Customer expectations; (d) improper use of the product in violation of usage instructions (application on damaged skin, mucous membranes, eyes, airways); (e) indirect damage caused by incorrect use (stained clothing, soiled surfaces due to non-compliant application).

15.3 Bronzata's overall liability for any claim arising from or connected to these Terms is limited, to the extent permitted by law, to the amount actually paid by the Customer for the product in question.

15.4 The limitations of this article do not apply in case of fraud or gross negligence by Bronzata, nor to the inalienable rights of the Consumer under applicable law.


16. Indemnity

The Customer undertakes to indemnify and hold harmless Bronzata, its administrators, employees, partners and affiliates from any and all claims, damages, losses, costs, legal expenses arising from: (a) breach of these Terms by the Customer; (b) breach of third-party rights (intellectual property, privacy, confidentiality) by the Customer; (c) improper use of the products or Website by the Customer; (d) unlawful or fraudulent conduct by the Customer.


17. Modifications to Service and Terms

17.1 Bronzata reserves the right to modify, suspend or discontinue the Website or any of its functionality at any time, with or without notice, without incurring liability to the Customer.

17.2 Modifications to these Terms will be notified to Customers with active subscriptions at least 30 days in advance via email. A Customer who does not accept the modifications has the right to cancel the subscription without penalty before the effective date. Continued use of the Website or placement of new orders after the effective date constitutes acceptance of the new conditions.


18. Suspension and Termination

18.1 Bronzata reserves the right to unilaterally suspend or terminate the Customer's access to the Website and Services, and to cancel pending orders, in case of: (a) documented breach of these Terms; (b) fraud or attempted fraud; (c) unfounded chargeback judged by the payment network; (d) repeated abuse of Subscription or Refund policies; (e) offensive behaviour towards support staff or other Customers.

18.2 Ban list. Identities subject to measures under Art. 18.1 are added to the internal ban list and to lists shared with fraud processors (Signifyd, Riskified, NoFraud, Shopify Fraud Protect), with the effect of blocking new orders, subscription activation, participation in promotional programmes.


19. Regulatory Compliance

Bronzata operates in compliance with: Regulation (EC) 1223/2009 on cosmetic products; Italian Consumer Code and subsequent amendments; EU Directive 2011/83 on consumer rights; EU Directive 2019/2161 (Omnibus); Regulation (EU) 2016/679 (GDPR); ePrivacy Directive 2002/58/EC; Regulation (EC) 593/2008 (Rome I).


20. Privacy

Bronzata processes the Customer's personal data in compliance with the GDPR, within the limits and for the purposes described in the Privacy Policy and Cookie Policy, which form an integral part of these Terms.


21. Force Majeure

Bronzata shall not be liable for delays or breaches of contract arising from force majeure events, understood as events beyond the reasonable control of Bronzata, including but not limited to: natural disasters, pandemics, acts of war, terrorism, strikes, blackouts, network interruptions, acts of public authority, documented raw material scarcity, severe disruptions by payment processors or couriers.


22. Governing Law and Jurisdiction

22.1 Substantive law. These Terms are governed by the laws of the State of Wyoming (United States).

22.2 EU Consumer Customers. Under Regulation (EC) 593/2008 (Rome I) Art. 6, the mandatory consumer protection provisions of the country of the Customer's residence apply. In Italy: Consumer Code and subsequent amendments.

22.3 Italian Consumer Forum. Under Consumer Code Art. 33, for disputes with Consumer Customers resident in Italy, the Consumer Forum is exclusively competent, namely the court of the Customer's place of residence or domicile.

22.4 B2B / non-EU Forum. For any dispute with professional Customers (B2B) or non-EU residents, the Court of Cheyenne, Wyoming (USA) is exclusively competent, and the parties accept the personal and territorial jurisdiction of such courts.

22.5 ADR. EU Consumers have the right to access the European ODR platform for online dispute resolution (ec.europa.eu/consumers/odr).


23. Subscriber Subscriptions

23.1 Bronzata Subscriber subscriptions are governed entirely by the Subscription Policy, which constitutes an integral and material part of these Terms.

23.2 Activation of a subscription requires explicit pre-checkout acceptance of the Subscription Policy via dedicated checkbox. This acceptance is required for the specific clauses relating to Welcome eligibility, anti-abuse measures, bonuses and gating, refunds, chargebacks and jurisdiction.

23.3 In case of conflict between these Terms of Service and the Subscription Policy concerning subscriptions, the Subscription Policy prevails as the special discipline.


24. Data Protection and GDPR

24.1 Bronzata Beauty, as a non-EU entity processing data of EU residents, operates in compliance with Regulation (EU) 2016/679 (GDPR).

24.2 To exercise rights under GDPR Arts. 15-22 (access, rectification, erasure, portability, objection, restriction): support@bronzata.com.

24.3 Bronzata undertakes to appoint an EU Representative under GDPR Art. 27, where required by processing volume. For full details of processing methods, please refer to the Privacy Policy and Cookie Policy.


25. General Provisions

25.1 This version of the Terms (v2.0 — 16 May 2026) supersedes all previous versions.

25.2 Partial invalidity. The invalidity, nullity or ineffectiveness of a single clause of these Terms does not result in the invalidity of the remainder, which shall continue to produce their effects.

25.3 Assignment. Bronzata may assign the rights and obligations arising from these Terms to group companies or third-party successors, upon notice to the Customer. The Customer may not assign their rights to third parties without written authorisation from Bronzata.

25.4 Waiver. Any waiver by Bronzata with respect to breaches of these Terms by the Customer does not constitute a waiver of its rights.

25.5 Prevailing language. In the event of discrepancy between the Italian version and the English version of these Terms, the Italian version prevails for Customers resident in Italy.

25.6 Communications. All official communications between the parties must be sent via email to support@bronzata.com (Bronzata) or to the email address provided by the Customer in the account/order (Customer).

Bronzata Beauty recognises and respects all consumer rights guaranteed by Italian and European law. These conditions do not limit in any way the inalienable rights of law. Any clauses that prove to be in conflict with mandatory provisions will be automatically replaced by the applicable legal provisions.

Explicit approval under Italian law. The Customer, by completing the order, declares that they have read and specifically accepted the onerous clauses in the following articles: §15 (Limitation of Liability), §16 (Indemnity), §17 (Modifications to Service), §18 (Suspension and Termination), §22 (Jurisdiction), §23 (Subscriber Subscriptions), §25.3 (Assignment).
